Participation Agreement

This Participation Agreement (herein called "Agreement") between yourself (herein called "Particpant") and the Association operating as "Dundas Valley Bujutsu" and its officers, instructors or other persons (herein collectively refered to as "DVB"), defines the terms of membership, participation and entitlements of the Participant.

The Participant will be directed to review this Agreement and accept its terms before participating in any activity, or following any instruction provided by the DVB.

The Participant will ensure any DVB instructor is aware of any medical condition or disability that may limit or potentially be affected by any discussions or activities that may occur between the Participant and DVB.

To become a Member of the DVB group, the Participant needs provide their Name, Address, Telephone Number, Email Address, Date Birth and a written list of any pertinent Medical Conditions or Disabilities; along with signing a membership agreement. A Member is is entitled to use any facilities or equipment provided by, and receive martial arts instruction from the DVB commencing on the date of this agreement, until either the Participant or the DVB terminates this agreement.

The Particpation and Membership is subject to the following terms and conditions:

1. DVB requires 5 days written notice to rescind this agreement.
2. DVB may update this agreement at any time.
3. DVB does not ask for or require any money or consideration for participation, at this time. Though, donations are welcome and will be used to help fund instructor training.
4. Any moneys or other consideration paid are non-refundable.
5. If there is a payment schedule and the Participant breaks that payment schedule, the entire balance of the any membership or purchase fees become immediately due without notice, and shall be charged to a credit card the Participant has provided to the DVB. The Participant authorizes any such charges.
6. The Participant acknowledges that they are responsible for membership payments, if membership payments are negotiated, even if they do not make use of or attend any facilities, equipment, training, instruction or classes.
7. A membership term may be extended (for example, due to sickness or absence), but this may only occur if the Participant makes such a request.
8. Participant asserts they have no disability or impairment preventing their participation in any events, activities or gatherings of the DVB.
9. Participant acknowledges that they have disclosed and will continue to disclose all medical and physical disabilities to the DVB.
10. Participant understands and acknowledges that participation in the DVB's Martial Arts training program may involve strenuous physical activity, physical contact, and may be hazardous and may result in personal injury.
11. Participant confirms that they are voluntarily participating in these activities and that they will assume all risk of injury which may result from these activities. Participant always has the discretion to "opt-out" of any activity.
12. Participant permits the DVB to take all reasonable steps should the Participant sustain injury and require emergency medical treatment.
13. This agreement limits the liability of the DVB and its principals, instructors, administrators and other participants, including in an event where the Participant is injured on any premises, facility or location, or during any events, activities or gatherings of the DVB.
14. Participant acknowledges that the DVB is not responsible for any injury or loss they sustain, including theft or damage of the Participant's personal property, even if attributed to negligence of the DVB.
15. Participant understands promotions and rankings are not guaranteed, but are dependent on the Participant's personal progress.
16. The DVB reserves the right to revoke any membership without refund if the Participant fails to keep and obey all rules and regulations that are currently in force or which may be prescribed by the DVB in the future.
17. Training with the DVB or with any affiliated martial arts school is up to the discretion of the DVB director and the affiliated school, and must be pre-approved.
18. Participant agrees to not directly or indirectly, in any manner whatsoever, either as a partner or as an officer, director, employee or agent of any corporation, partnership or organization, engage in the instruction or teachings of any martial arts program or be concerned with any business related to martial arts for a period of five years and/or fifteen kilometers of the DVB or any affiliated martial arts schools, following the termination of this agreement.
19. Participant authorizes the use of photos and/or videos for any promotional activities of the DVB. This authorization is assumed unless the Participant actively revokes this authorization.
20. Participant understands the DVB may communicate with them using the various mediums including telephone, mail, email, and other mediums, and the Participant authorizes such communication.
21. Participant states that they have had all their questions answered prior to signing this agreement.
22. In the case of a discrepancy between this agreement and any other rules or written materials, this agreement will be taken as correct and any jurisdictional laws shall apply.

Before partipating any any DVB event or activity, or following any instruction provided by DVB, the Participant asserts they have reviewed this Agreement and accepted its terms. Having acknowledge all of the above, I hereby RELEASE AND FOREVER DISCHARGE the DVB operating as "Dundas Valley Bujutsu" and all its officers, directors, shareholders, instructors, assistants and employees from any and all claims that I may have for loss of life, bodily and personal injury, medical expenses, property damage and all other incidental expenses or loss, which may arise as a result of my participation.
